Real Problems With Magic Jack .... Is Majic Jack Hiding Something?
Read the TOS ("Terms Of Service) for Magic Jack VERY closely. You might be surprised at what you see there. Or NOT see there. I've pointed out issues with Magic Jack in earler articles on Broadband Nation (see archives). But this revelation should make you VERY concerned.
In short ... to quote a favorite cartoon character .... "Be Afwaid, Very Afwaid".
This is just pointing out the not-so-obvious that is hidden deep within the TOS, and other 'gotcha's' that you won't realize until after you give up your $ and privacy!
First:

CAUTION: it looks like they track the number that calls and places you into a repeating loop if you call back a second time. so if you need to call a second time make sure its from a different number.
Second:
In the TOS you agree that everything in your computer is fair game for them to know about, all web sites, email, and numbers called are there info.
You agree to have all of your information resold to third parties.
There is no Un install for this program. Even if you stop using it, it gathers your information.
You are put under high pressure to sign up and pay for 5 years.
There is no published phone number, email address, or mailing address.
All customer support is done via type in the box chat.
There is no written warranty on the box. It breaks, you buy another to maintain your service.
Computer must be left on to make or receive calls.
Pop up window comes to front of screen anytime there is a call in or out call.
MajicJack Spyware slows down your computer even when you are not using MagicJack
Advertising is in the pop up box.
And yes, you do save around $150 a year not using a real Voip company.
At what little price people put on the information and security.
So ask yourself, is it really worth it?
Wait .... there's more.
Majic Jack is owned and run by YMAX. They are not a stand alone VoIP provider.
Also .....
"The software for the MagicJack does not run directly from the device. It fully installs on the Windows system, which also makes the MagicJack less attractive for situations where one might want to use it on someone else's computer (say when visiting family). Making this even worse, there was no easy way to uninstall the software from the system, with the program not even showing up in the Windows Remove Program window. UPDATE: MagicJack confirmed that there is currently no easy way to uninstall the software. The process required to uninstall the software requires multiple Windows Registry edits and the removal of several folders on the Windows system. Based on this, I wouldn't recommend using the MagicJack on the systems of friends, family or business associates." -- (see magicjack fails to cast a voip spell)
Nobody should accept having to leave unwanted software on a personal computer, or any tell-tale trace of the MJ program on a public computer, a business workstation, or a borrowed device.
The key concepts here are action and intent. IF MJ is not actively monitoring computer activity and collecting data about its customers, that's great. They would be taking no action that anyone could be concerned about.
But consider their intent. Their TOS spell out their intent -- the intent to feed context sensitive advertising, which requires manipulation of information from your brain through their software into their processors. There seems to be little restriction of what info their software can see. (Kind of like your home builder installing bugging devices and cameras into your bedroom, just not yet watching the feed.) Then there is the ability of MJ to modify their software (upgrape, anyone?) at any time, without the common user's ability to stop it, and that revision could include the spyware coding. While you, the uncommon user, have the ability to see what they are doing, the common user has no idea when the change is made. Now let's consider MJ's intent of not building in an UNINSTALL capability. I am suggesting that this exposes MJ's intent to have their software on your PC whether you're an active phone customer or not. What would be the intent of having that software on the PC of a former customer? (Consider, also, their "convenience" feature of taking the device with you so you can use it on a friend's PC -- thus installing the software on that machine, too!) What information could that software obtain that would be of value to MJ? And what could the common user do to stop it?
MJ could shut down their phone service tomorrow, and they have a window into 1 million PCs -- to feed advertising, log key strokes, and obtain surfing patterns.
By laughing at the TOS provisions, you are overlooking that they are warning you of their intent -- and protecting themselves from future legal action. "We told them what we were going to do. It was in our terms of service and the customers agreed." Case dismissed.
Several years ago there was another nice utility that was offered -- Weather Bug. Everyone liked Weather Bug. You downloaded a program and it was nice enough to give you accurate weather forecasts -- while it spied on you. That little program helped popularize the anti-spyware industry, which now extracts $50 a year out of millions of users.
Action: not guilty.
Intent: too soon to know for sure, but all the clues are right out there in the sunshine. You won't have to be Sherlock Holmes to figure this one out.
From their EULA:
“You also understand and agree that use of the magicJack device and Software will include advertisements and that these advertisements are necessary for the magicJack device to work … Our computers may analyze the phone numbers you call in order to improve the relevance of the ads”.
Any claims, legal proceeding or litigation arising in connection with the magicJack device or Software will be resolved by binding arbitration … in Palm Beach, Florida.”
In short, it not only has one agree to ads with its paid-for system, but claims that the ads are necessary for it to work. It will also snoop on your calls to target ads more accurately, and has you sign away your legal right to take it to court if it defrauds or otherwise harms you. Delightful.
Neither the EULA itself, nor any other privacy or legal information, can be easily found at its homepage. It’s not even provided at the point of sale, where one enters credit card info, email and street addresses as such, so as to gain access to the service and have your MagicJack dongle delivered. I found the EULA’s URL through Google.
When you access MajicJack’s instant web help page, a bizarre series of “compatibility tests” take place first, reporting lies like “Your MagicJack is functioning properly” even if you don’t have one installed.
Even the “look how many people came for a free trial” counter on the homepage is a fake, a javascript applet that increments itself automatically:

As if targeted advertising, systematic privacy invasion, and the signing away of your legal rights wasn’t evil enough!

Magic Jack specializes in development, design, manufacturing and distribution of special patented Magic Jack devices that allow its owners to make free calls. However, judging from the amount of the complaints you find on this great site www.pissedconsumer.com it is obvious that the calls are not that free and the services are not that perfect.

I recently got magic jack and it works well, BUT I can't get my AREA code 0f 360. I use it on a totatly independent computer with nothing for them to see.

Magic Jack is only $20 a year. Naturally it’s going to attract a lot of users. For those who are worried about MJ snooping on their activities (this does NOT include me), there is a very easy solution here. After you connect your MJ, it will automatically contact the MJ site (the Mother Ship), and then it will install its software. After this is done you now have (or should have) a completely functioning phone. Now, to avoid snooping, as well as the MJ popup box (it really doesn’t bother me), simply create another user profile on your computer (you can also privatize the profile). After you’ve done this, log onto your new profile now, while your other user profile, which MJ is installed on, is still running. Viola. Your phone will still work. You won’t see the MJ popup window; and you will also not have to worry about website tracking - since MJ isn’t installed on your 'new' user profile.
p.s. I am assuming everyone knows how to create an additional user profile on Windows.
p.s.s My MJ works great(it's my second phone. Can't beat the price either.

I though I would the Majic Jack a try so I placed the call and was told by the automated service I was going to receive a confirmation email after the order is processed. I never got my email so I called and the person Nash I chatted with gave me an address to keep an eye on my order. He also gave me an email address to use with majic jack. I looked up the address to check the status of my order and it was a majicians address to order majic tricks www.majicjack.com/orderstatus.html I called back and spoke to a wendel and he said in order for me to receive a confirmation email they need the password to my email. I forgot about the one Nash gave me. I freaked out wendel and asked him why would he need my password to my email he said thats the way they put us on file to get a confirmation I paniced and ended the chat called again and chatted with sharon. She also asked for my password so I gave her my majic jack address and my password they emailed me. all the email said was your password is 123456 so I gave that to her. She said that was not an accurate email she wants my actual everyday email and password I said you are out of your mind to think I would give you personal information like that. I have personal information in my address she said they dont look at anything. They aslo said they only asked for email address on the phone to process the application. no one gets a confirmation email unless you purchase this product on line. I said I haven't even received the item yet and i am having so many problems please cancel my order. We will wait and see if they charge my account. I informed Sharon if there are any charges applied to my account, I will file suit with the company.

Got my MJ today, but requested RMA due to the poor voice quality... lousey that there is no phone support... and more alarming there is no uninstall pgm, as written above. ...makes one wonder as to any spyware, as you pointed out in your comments... i agree that it's suspicious strange and concerning... when it is too good to be true, well, it was too good to be true!

I made the mistake of ordering Majic Jack. I listen to Sharon recorded voice tell me I could get only 3 magic jack at their introductory price. I thought I bought one, I received. I received 3 and was billed shipping and handling fee of $89.00. Do not call this number. It is a rip off.

I see no indication that the MJ software monitors keystrokes or anything of that manner. The "targeted advertising" works by analyzing any numbers that you dial, that are businesses. If you call Walmart alot they might feet you Walmart ads etc. No worse than Google does with their email and adwords.

This is one of the most devious scam prodcuts and gorrila marketing that I've seen. This is just a scam and con. "To Get this scumbag Dan Borklosy what ever his name is ,He sells your personal informaiton to a third party. that includes your personal browsing history. If you went to an X rated porno site "by accident" this guy will know. When you go to check your Bank account ,this guy will know. he will know your credit card information., personal ,confidential information that you should not permit anyone to know. he will sell this to foreign partys if he can. who knows where your information will end up ,maybe Nigeria,Somalia. Iran. This also later could be used to blackmail people. Also you can not unistall this Majic Jack program from your operating system. this is spyware ,Check with the Palm Beach County BBB also this gym has criminal records and he is a defendant in numerous scams in Florida, he is presently under investigation by the florida Dept. of Law Enforcement. he is a scam artist. involved in an online criminal conspiracy.

I was speaking to someone who had all but sold me on the idea because she had just got it and is very happy with it. I was really impressed with the idea of being able to talk to anyone anywhere in the world. I just want to say thanks for the heads up!

Wow, what xxxx said about Eric, I got the same thing from Eric!
I ALSO GOT THE SAME THING FROM A FEW OTHERS AT MJ, WORD FOR WORD! Also, I found great difficulty in talking to anyone while downloading a program or files into my computer, it breaks up worse than a cell phone. Lastly, I had problems reaching some numbers that I call on a reguler basis. I would dial the number, area code first mind you, and wait for the other line to ring. then, I would just get a dial tone. When I chatted with their "Tech" to fix this problem, 2 1/2 hours later, I ended up losing ALL OF MY CONTACTS!!! I lost a lot of very important numbers today, and am getting rid of Magic Jack.
and, I can't hardly believe tht when you dial 0 for an operator, there is none, just a recording saying your call went through! What a HOAX!

Wow, what a mess for a little device that cost $20 a year. It works great for me. Had it for alittle over 6 month.
The new upgrade is awesome and new look. People complaint about a 30 minutes limit per call with the new update. I haven't had this problem, maybe because I dont abuse the service and talk for hours and hours. I believe those who has the 30 minutes limit are those to really abuse the service, talk to much, and try to hack into it and do stuff they shouldn't be doing it.
Thats what I think! Keep up the GREAT work MagicJack, your product is okay with me and my entire family all across America and in South Amercia ( they have one too ).

Funny, my parents spent over an hour trying to get their DNwork bills straightened out and every 30 minutes they got cut off. That was how they found out about magic jacks 30 minute limit.
I hated weatherbug when it started showing up on every PC where I used to work and maintain the PCs. That was way back when Gator was stuffing the spyware in, and on POLICE computers at that. I think it's safe to say magicjack is the new gator.
I suspect within a year the current CEO will sell the company off to some investors, make off with tons of cash, and watch from a beach surrounded by silicone enhanced women as the company sinks like the titanic from being unable to sustain it's model.

Holy crap i just saw this commercial for the first time today in seattle and i gotta admit i was gonna be one who was scammed! I am a full time college student and was like hmmm now i get to talk to my family whenever i want for only 20 a year. Well my fellow consumers thank you for helping me make my mind up for me. Anyone who didn't read the TOS before they bought the magicJack, it's their own fault.
I knew everything before I purchased the device, and I still bought it.
Works fine for me.
I don't need to uninstall it, and if I ever do I will just uninstall it. Just because software doesn't have an uninstall feature doesn't mean anything. The software itself is useless without plugging in the dongle anyways.
They are not actively monitoring computer activity and if they where you would hear about it. Trust me.
Magicjack has been around for a few years now and has yet to feed us advertising. If they do, you wont hear it on the phone. It will just be in the softphone, which can easily be hidden.
the fake counter is something i also already knew and its used be companies all the time. just look at the infomercials that say "only 3 more hours left"... Get over it, it's a common sales tactic.

Well, I have had my MagicJack for over a year and think it is worth it. I live in Costa Rica and use my MagicJack every day to call and receive calls from my friends and family in the States. Sure sometimes the quality is not very good but sometimes my broadband connection is poor or goes out altogether. Is that MagicJack’s fault? Sometimes I call a cell phone and the call is dropped, is that MagicJack’s fault 100% of the time? When I call another VOIP phone and the quality is poor or the call is dropped (not often), is that MagicJack’s fault 100% of the time. Sometimes when I call a land line the quality is poor or the call is dropped (not often), maybe I am downloading a movie, or something on another computer at the same time, is this MagicJack’s fault 100% of the time? Oh, I run MagicJack on a “Boat Anchor” computer, you know a very old junk computer (no monitor, keyboard, or mouse), just an old barebones system worth maybe $50 if that. If MagicJack wants to monitor this “Boat Anchor”, go ahead.
The fact of the matter is that MagicJack is a serious threat to a very powerful and declining consumer telecommunications industry. There is a very powerful telecommunication lobby in Washington. After all, the United States has the best government money can buy. At $20 per year, what do you expect? If you require 100% quality, 100% of the time, if you require 100% secure communication 100% of time, if you require the highest quality premium (from native English speaking) customer service 100% of the time, save your 20 bucks and go elsewhere, because you will not get it from MagicJack.
It would be very expensive for me to all the USA from Costa Rica or I could get something like Vonage, but what guaranty and what do I get there. My neighbor has Vonage and they have the same problems and pay much more.
If installing MagicJack is a concern, why not creating a Restore Point and save it. As for me I am happy with my MagicJack and will continue to use it.

GET A JUNK BOX WITH XP. INSTALL IT THERE. I JUST SET UP MINE. IT INSTALLED ITSELF GREAT. I PUT A POWERED USB 2.0 1.1 HUB BETWEEN THE BOX AND MJ, AS PER THE RECOMMENDATIONS OF THE GUY UP AT RADIO SHACK. THANKS FOR THE WARNING ABOUT ALL THE SPY WARE STUFF, BUT IF YOU THINK FOR ONE MINUTE YOUR NOT IN THE LOOP ANYWAY, DREAM ON. What are you people doing with your computers that is so secret anyway?
After all aren't we connected to a public network? Also, I have an internet security system that catches spyware, when and if needed.
My MJ works great. No 30 minute limits nor one hour. We talk all over USA and Canada with no problems. Read the big cell phone companies TOS. They say the same stuff and don't guarantee perfect phone service, they only say it on tv and radio commercials. Do you people think no one can listen to your cell phone or land line coversations? I have a cheap police scanner purchased at radio shack and I hear plenty and it's by accicent. I will use MajikJack as long as I can. What do you want for $19.95 per year. I have used every major cell phone company out there and don't get as good results, with a contract.

i hate it. and after reading this now i know why. i get a dial tone but nothing happens after i dial the number. it worked for the first three days and now nothing. and i cant get in touch with anyone. i think i will destroy my computer and. and buy another one. i am going to try a few of the ideas i have read on this site. but i don't know. i am a ll scared now. for those of you you have read this and still think you have a great deal, either you are in denial of the fact that you have been played, or you are one of them.

we just talk to Live onecare who is owned By microsoft which is supposed to protect your PC.
Well guess what they cant even diffuse the problem. So evidently this majic jack is acting as Big Brother to computer users. All the numbers listed on this page are not any good. I petitioned to have a public notice to all consumers to be warned of this problem and for Microsoft to mack it unavailable for people to download the Magic Jack until they agree that the consumer has control over the product they are paying for.

this is to the anonomous who said the part about what do we have that is so secret on our computers?....... Well anything you do on your PC that has to do w/ internet can be published, and you are right but did u realize that magic jack can get passed your virus protection and make anything it chooses available because you gave them permission. to do so. So you may think you are protected by your antivirus and spyware... but you are not. After research I found that internet security only protects you if the program hasnt allready been given permission to enter. And seeing that Magic Jack was given that permission,.....Guess what you gave them permission. So are you protected?....NO. They can see what you are doing even if the Magic Jack is unplugged, seeing that it is a hidden embedded file, that continuously, runs. Anytime time you get on the computer, and the ethernet cable is plugged in to your computer, they can transmiit information. You gave them the key to your backdoor.

HI my name i Alex,and i had my magicjack for about 3-4 mons and a first it worked very good,then i started to have all kinds of problems.I troubleshooted
it many times. And when i contacted them for a REPLACEMENT they would not send it, or lessen to me.
I told them that i will let every body know about that,they replayed (do what you need to do) so i just wonted to let everybody to know that this is what you can expect from this kind of service. You will pay for year and be able to use it for couple of mounts.

i am seriously considering getting a majic jack. but now that i read these blogs, i am more cautious! perhaps this is REAL, ya know? if you can prove weatherbug did this, why cant majik jack? gotta warn all of the others that shown interest in this. perhaps the blank account would also be a decent protection, but then again, if it gets past SPYWARE, why cant it get past all accounts and be in the main system?? seems possible to me, unless someone can better explain the TRUE SEPARATION of these user accounts to me...

I have MJ and love it. The only problem I have once in a while is the software gets corrupt and I have to format the MJ drive.
You have to leave the computer on all the time to get or place calls is the only drawback I see. You will pay more in electricity than a regular phone .

I just got a majicJack and began using it today. The quality is the same as the phone company and it was really easy to install. I read the TOS and had some concerns as well. There is a comment by someone on this blog that says to create a different identity on your internet browser and use that. That will work great. If you are using broadband and have more than one computer or an older computer that you can connect then you can just use that computer for the phone and other non personal business and get around any potential problems as well. Bottom line for me is about $1.70 per month for phone service is a whole lot cheaper than the phone company and majicJack can't do anything any worse than the phone company already does to you.

If I lived in the US I don't think I would use a Majic Jack. But as an ex-pat, in Bolivia, it is really great for calling the US. I just switch phone cords into the phone and get a US dial tone.
That's a real benefit for $20 per year.

I'm sorry this isn't directly about my experience with MJ as i found this site while doing some research on MagicJack...I appreciate the comments, but please, PLEASE, try to make sense in your typing...there is a backspace and delete key...maybe even spell check? I am now leaving this blog much more confused than when I entered it, absolutley no closer to a decision.
Most of the comments posted on this blog look and sound as if they were written by children...I'm sorry but i can't put much confidence in a comment someone writes when they misspell every other word..."leik?"...over and over even.
I'm sorry about the rant but i felt something had to be said...if you have something important to say, just try to make it legible and your point will be received with much more enthusiasm.

I was considering a MJ as well and glad I came across this site. As an Information Security/Risk Mgmt Consultant for banks, I am pleased to see others who do their homework before attaching a device such as this to their PC. With the rapid increase in identity theft, this appears to possibly be laying a foundation to add fuel to this fire. I'm a little confused however, in that MJ would not be subjected to future legal action because they should be held to the requirements of the FTC's Safeguard/Privacy Rules (GLBA). This law requires that they disclose the type of non-public personal information they collect and whether or not they share or sell it to 3rd parties. If they do, they are required to give consumers the ability to opt out of this "sharing". One of the exceptions to this, is where the "sharing" is necessary to provide the service. This is probably why they are saying that this is the reason for collection of data. But honestly, I can't see the reasoning behind that argument. If you feel that you have been scammed or your privacy has been vilated, it might be worth filing a complaint with the FTC. Whether you signed the TOS or not, if they did not give you the ability to opt out, they likely violated the law. It also makes me wonder if Wal-Mart is on the receiving end of some of the "data" they collect. Not saying they are; it just makes me wonder.

I bought a Magic Jack to experience the savings and the new technology. I have a bit of a older computer with USB-1 ports. I connected my Magic Jack following all the instructions very carefully, then tried the phone finding myself disappointed. It made calls, but the software would keep disconnecting and recycling itself back up every few minutes. Also the voices I heard on the phone sounded like they were under water sometimes (kinda worbly).
Refusing to say no to this invention, … I took my Magic Jack and a smaller house phone to our local public library and hooked up on one of the public computers. I’ll be damned, the performance left me absolutely speechless. Rock solid stability, crystal clear audio and it wasn’t dropping my calls.
This told me my purchase of the Magic Jack was a good one. The problem I was having at home must have been in my computer.
My next stop was a computer shop where I walked them through my experiences carefully and then asked for their advice. The guy in the computer store asked if I had usb-2 ports on my computer, … I replied “No just usb-1 ports”. He confidently put a small box on the counter top that was labeled usb-2 pci card. He said “From what you just told me, I’m positive this will solve your problem because phones are like a type of media, the usb-2 ports run more than twice as fast as the usb-1 ports. Your usb-1 ports are working, but they are struggling to get the job done. Usb-2 ports won’t struggle to work your Magic Jack”.
I went home and installed my new usb-2 port which cost less than $25.00, … then retried my Magic Jack and telephone. I was floored! It was behaving just as it did in the library. Rock solid stability, crystal clear audio and I never saw it drop another call or senselessly recycle itself ever again.
I am very happy. I’ve been using my Magic Jack for years with no complaints, and pocketing the savings on my telephone activity.
I’m very thankful to whoever invented this device. I also like the lower prices they came out with, … renew at $59.00 for five years. Absolutely sensational!

Thanks for information "Joe". But by any chance do you sell these USB ports or are you a representative of MJ? Again, I"m astounded that a public library would not have better security on it's workstations and prohibit users from attaching external devices and installing third-party software at will. I'm not necessarily questioning the validity of your story and saying they don't, but if they do, it is this type of complacency and/or ignorance that places them and other users at risk. IMO, the best thing to do with respect to the MJ, is to read the TOS and understand exactly what you will be signing up for if you do go forward with the service. But, also understand that you do have the right to request the ability to opt out of sharing. Ask them to provide you with a written copy of their Privacy Policy and if you do not want them to share your personal information with 3rd parties, tell them that you want to sign an opt out. In addition, you should also ask them if they have implemented a "Red Flag" program, which allows them to detect, prevent, and mitigate identity theft. This is a program they are required to have in writing and implemented no later than May 1st. If they are a company of integrity and are compliant with the law, they should be willing to attest to the fact that they have such a program in place. Get this attestation in writing. Then if your information is compromised at any time, you would have a strong legal basis for restitution. If they are not compliant or refuse to provide you with the attestation, I can guarantee you, this is not something the FTC would take lightly.

I too was taken in by the Magic Jack but only after checking with a few other people. My cousin in Florida says he has owned one for years and is totally satisfied with it. My brother-in-law has had his for over two years and raves about it. With that, I decided to order one on-line. The gadget worked perfectly for about two weeks, then boom! I began to have several problems. When my computer wasn't locking up, it was running extremely slow. Then I got a terrible virus and had to take the computer to have the virus removed. The computer has not worked properly since.
This may be a hit or miss device as it seems to work for some but not for others. Unfortunately, they have gotten $40.00 out of me, which pisses me off. I think about the millons of dollars the company has received from people like me who end up with a product that is no good. What a scam!!!!
Oh, I forgot that there was a class action lawsuit against the company in Florida.

Real Problems With Magic Jack .... Is Majic Jack Hiding Something?
Read the TOS ("Terms Of Service) for Magic Jack VERY closely. You might be surprised at what you see there. Or NOT see there. I've pointed out issues with Magic Jack in earler articles on Broadband Nation (see archives). But this revelation should make you VERY concerned.
In short ... to quote a favorite cartoon character .... "Be Afwaid, Very Afwaid".
This is just pointing out the not-so-obvious that is hidden deep within the TOS, and other 'gotcha's' that you won't realize until after you give up your $ and privacy!
First:

CAUTION: it looks like they track the number that calls and places you into a repeating loop if you call back a second time. so if you need to call a second time make sure its from a different number.
Second:
In the TOS you agree that everything in your computer is fair game for them to know about, all web sites, email, and numbers called are there info.
You agree to have all of your information resold to third parties.
There is no Un install for this program. Even if you stop using it, it gathers your information.
You are put under high pressure to sign up and pay for 5 years.
There is no published phone number, email address, or mailing address.
All customer support is done via type in the box chat.
There is no written warranty on the box. It breaks, you buy another to maintain your service.
Computer must be left on to make or receive calls.
Pop up window comes to front of screen anytime there is a call in or out call.
MajicJack Spyware slows down your computer even when you are not using MagicJack
Advertising is in the pop up box.
And yes, you do save around $150 a year not using a real Voip company.
At what little price people put on the information and security.
So ask yourself, is it really worth it?
Wait .... there's more.
Majic Jack is owned and run by YMAX. They are not a stand alone VoIP provider.
Also .....
"The software for the MagicJack does not run directly from the device. It fully installs on the Windows system, which also makes the MagicJack less attractive for situations where one might want to use it on someone else's computer (say when visiting family). Making this even worse, there was no easy way to uninstall the software from the system, with the program not even showing up in the Windows Remove Program window. UPDATE: MagicJack confirmed that there is currently no easy way to uninstall the software. The process required to uninstall the software requires multiple Windows Registry edits and the removal of several folders on the Windows system. Based on this, I wouldn't recommend using the MagicJack on the systems of friends, family or business associates." -- (see magicjack fails to cast a voip spell)
Nobody should accept having to leave unwanted software on a personal computer, or any tell-tale trace of the MJ program on a public computer, a business workstation, or a borrowed device.
The key concepts here are action and intent. IF MJ is not actively monitoring computer activity and collecting data about its customers, that's great. They would be taking no action that anyone could be concerned about.
But consider their intent. Their TOS spell out their intent -- the intent to feed context sensitive advertising, which requires manipulation of information from your brain through their software into their processors. There seems to be little restriction of what info their software can see. (Kind of like your home builder installing bugging devices and cameras into your bedroom, just not yet watching the feed.) Then there is the ability of MJ to modify their software (upgrape, anyone?) at any time, without the common user's ability to stop it, and that revision could include the spyware coding. While you, the uncommon user, have the ability to see what they are doing, the common user has no idea when the change is made. Now let's consider MJ's intent of not building in an UNINSTALL capability. I am suggesting that this exposes MJ's intent to have their software on your PC whether you're an active phone customer or not. What would be the intent of having that software on the PC of a former customer? (Consider, also, their "convenience" feature of taking the device with you so you can use it on a friend's PC -- thus installing the software on that machine, too!) What information could that software obtain that would be of value to MJ? And what could the common user do to stop it?
MJ could shut down their phone service tomorrow, and they have a window into 1 million PCs -- to feed advertising, log key strokes, and obtain surfing patterns.
By laughing at the TOS provisions, you are overlooking that they are warning you of their intent -- and protecting themselves from future legal action. "We told them what we were going to do. It was in our terms of service and the customers agreed." Case dismissed.
Several years ago there was another nice utility that was offered -- Weather Bug. Everyone liked Weather Bug. You downloaded a program and it was nice enough to give you accurate weather forecasts -- while it spied on you. That little program helped popularize the anti-spyware industry, which now extracts $50 a year out of millions of users.
Action: not guilty.
Intent: too soon to know for sure, but all the clues are right out there in the sunshine. You won't have to be Sherlock Holmes to figure this one out.
From their EULA:
“You also understand and agree that use of the magicJack device and Software will include advertisements and that these advertisements are necessary for the magicJack device to work … Our computers may analyze the phone numbers you call in order to improve the relevance of the ads”.
Any claims, legal proceeding or litigation arising in connection with the magicJack device or Software will be resolved by binding arbitration … in Palm Beach, Florida.”
In short, it not only has one agree to ads with its paid-for system, but claims that the ads are necessary for it to work. It will also snoop on your calls to target ads more accurately, and has you sign away your legal right to take it to court if it defrauds or otherwise harms you. Delightful.
Neither the EULA itself, nor any other privacy or legal information, can be easily found at its homepage. It’s not even provided at the point of sale, where one enters credit card info, email and street addresses as such, so as to gain access to the service and have your MagicJack dongle delivered. I found the EULA’s URL through Google.
When you access MajicJack’s instant web help page, a bizarre series of “compatibility tests” take place first, reporting lies like “Your MagicJack is functioning properly” even if you don’t have one installed.
Even the “look how many people came for a free trial” counter on the homepage is a fake, a javascript applet that increments itself automatically:

As if targeted advertising, systematic privacy invasion, and the signing away of your legal rights wasn’t evil enough!

Magic Jack is only $20 a year. Naturally it’s going to attract a lot of users. For those who are worried about MJ snooping on their activities (this does NOT include me), there is a very easy solution here. After you connect your MJ, it will automatically contact the MJ site (the Mother Ship), and then it will install its software. After this is done you now have (or should have) a completely functioning phone. Now, to avoid snooping, as well as the MJ popup box (it really doesn’t bother me), simply create another user profile on your computer (you can also privatize the profile). After you’ve done this, log onto your new profile now, while your other user profile, which MJ is installed on, is still running. Viola. Your phone will still work. You won’t see the MJ popup window; and you will also not have to worry about website tracking - since MJ isn’t installed on your 'new' user profile.
p.s. I am assuming everyone knows how to create an additional user profile on Windows.
p.s.s My MJ works great(it's my second phone. Can't beat the price either.

I though I would the Majic Jack a try so I placed the call and was told by the automated service I was going to receive a confirmation email after the order is processed. I never got my email so I called and the person Nash I chatted with gave me an address to keep an eye on my order. He also gave me an email address to use with majic jack. I looked up the address to check the status of my order and it was a majicians address to order majic tricks www.majicjack.com/orderstatus.html I called back and spoke to a wendel and he said in order for me to receive a confirmation email they need the password to my email. I forgot about the one Nash gave me. I freaked out wendel and asked him why would he need my password to my email he said thats the way they put us on file to get a confirmation I paniced and ended the chat called again and chatted with sharon. She also asked for my password so I gave her my majic jack address and my password they emailed me. all the email said was your password is 123456 so I gave that to her. She said that was not an accurate email she wants my actual everyday email and password I said you are out of your mind to think I would give you personal information like that. I have personal information in my address she said they dont look at anything. They aslo said they only asked for email address on the phone to process the application. no one gets a confirmation email unless you purchase this product on line. I said I haven't even received the item yet and i am having so many problems please cancel my order. We will wait and see if they charge my account. I informed Sharon if there are any charges applied to my account, I will file suit with the company.

I see no indication that the MJ software monitors keystrokes or anything of that manner. The "targeted advertising" works by analyzing any numbers that you dial, that are businesses. If you call Walmart alot they might feet you Walmart ads etc. No worse than Google does with their email and adwords.

I was speaking to someone who had all but sold me on the idea because she had just got it and is very happy with it. I was really impressed with the idea of being able to talk to anyone anywhere in the world. I just want to say thanks for the heads up!

I ALSO GOT THE SAME THING FROM A FEW OTHERS AT MJ, WORD FOR WORD! Also, I found great difficulty in talking to anyone while downloading a program or files into my computer, it breaks up worse than a cell phone. Lastly, I had problems reaching some numbers that I call on a reguler basis. I would dial the number, area code first mind you, and wait for the other line to ring. then, I would just get a dial tone. When I chatted with their "Tech" to fix this problem, 2 1/2 hours later, I ended up losing ALL OF MY CONTACTS!!! I lost a lot of very important numbers today, and am getting rid of Magic Jack.
and, I can't hardly believe tht when you dial 0 for an operator, there is none, just a recording saying your call went through! What a HOAX!

Wow, what a mess for a little device that cost $20 a year. It works great for me. Had it for alittle over 6 month.
The new upgrade is awesome and new look. People complaint about a 30 minutes limit per call with the new update. I haven't had this problem, maybe because I dont abuse the service and talk for hours and hours. I believe those who has the 30 minutes limit are those to really abuse the service, talk to much, and try to hack into it and do stuff they shouldn't be doing it.
Thats what I think! Keep up the GREAT work MagicJack, your product is okay with me and my entire family all across America and in South Amercia ( they have one too ).

Funny, my parents spent over an hour trying to get their DNwork bills straightened out and every 30 minutes they got cut off. That was how they found out about magic jacks 30 minute limit.
I hated weatherbug when it started showing up on every PC where I used to work and maintain the PCs. That was way back when Gator was stuffing the spyware in, and on POLICE computers at that. I think it's safe to say magicjack is the new gator.
I suspect within a year the current CEO will sell the company off to some investors, make off with tons of cash, and watch from a beach surrounded by silicone enhanced women as the company sinks like the titanic from being unable to sustain it's model.

I am a full time college student and was like hmmm now i get to talk to my family whenever i want for only 20 a year. Well my fellow consumers thank you for helping me make my mind up for me. Anyone who didn't read the TOS before they bought the magicJack, it's their own fault.
I knew everything before I purchased the device, and I still bought it.
Works fine for me.
I don't need to uninstall it, and if I ever do I will just uninstall it. Just because software doesn't have an uninstall feature doesn't mean anything. The software itself is useless without plugging in the dongle anyways.
They are not actively monitoring computer activity and if they where you would hear about it. Trust me.
Magicjack has been around for a few years now and has yet to feed us advertising. If they do, you wont hear it on the phone. It will just be in the softphone, which can easily be hidden.
the fake counter is something i also already knew and its used be companies all the time. just look at the infomercials that say "only 3 more hours left"... Get over it, it's a common sales tactic.

Well, I have had my MagicJack for over a year and think it is worth it. I live in Costa Rica and use my MagicJack every day to call and receive calls from my friends and family in the States. Sure sometimes the quality is not very good but sometimes my broadband connection is poor or goes out altogether. Is that MagicJack’s fault? Sometimes I call a cell phone and the call is dropped, is that MagicJack’s fault 100% of the time? When I call another VOIP phone and the quality is poor or the call is dropped (not often), is that MagicJack’s fault 100% of the time. Sometimes when I call a land line the quality is poor or the call is dropped (not often), maybe I am downloading a movie, or something on another computer at the same time, is this MagicJack’s fault 100% of the time? Oh, I run MagicJack on a “Boat Anchor” computer, you know a very old junk computer (no monitor, keyboard, or mouse), just an old barebones system worth maybe $50 if that. If MagicJack wants to monitor this “Boat Anchor”, go ahead.
The fact of the matter is that MagicJack is a serious threat to a very powerful and declining consumer telecommunications industry. There is a very powerful telecommunication lobby in Washington. After all, the United States has the best government money can buy. At $20 per year, what do you expect? If you require 100% quality, 100% of the time, if you require 100% secure communication 100% of time, if you require the highest quality premium (from native English speaking) customer service 100% of the time, save your 20 bucks and go elsewhere, because you will not get it from MagicJack.
It would be very expensive for me to all the USA from Costa Rica or I could get something like Vonage, but what guaranty and what do I get there. My neighbor has Vonage and they have the same problems and pay much more.
If installing MagicJack is a concern, why not creating a Restore Point and save it. As for me I am happy with my MagicJack and will continue to use it.

What are you people doing with your computers that is so secret anyway?
After all aren't we connected to a public network? Also, I have an internet security system that catches spyware, when and if needed.
My MJ works great. No 30 minute limits nor one hour. We talk all over USA and Canada with no problems. Read the big cell phone companies TOS. They say the same stuff and don't guarantee perfect phone service, they only say it on tv and radio commercials. Do you people think no one can listen to your cell phone or land line coversations? I have a cheap police scanner purchased at radio shack and I hear plenty and it's by accicent. I will use MajikJack as long as I can. What do you want for $19.95 per year. I have used every major cell phone company out there and don't get as good results, with a contract.

i hate it. and after reading this now i know why. i get a dial tone but nothing happens after i dial the number. it worked for the first three days and now nothing. and i cant get in touch with anyone. i think i will destroy my computer and. and buy another one. i am going to try a few of the ideas i have read on this site. but i don't know. i am a ll scared now. for those of you you have read this and still think you have a great deal, either you are in denial of the fact that you have been played, or you are one of them.

Well guess what they cant even diffuse the problem. So evidently this majic jack is acting as Big Brother to computer users. All the numbers listed on this page are not any good. I petitioned to have a public notice to all consumers to be warned of this problem and for Microsoft to mack it unavailable for people to download the Magic Jack until they agree that the consumer has control over the product they are paying for.

Well anything you do on your PC that has to do w/ internet can be published, and you are right but did u realize that magic jack can get passed your virus protection and make anything it chooses available because you gave them permission. to do so. So you may think you are protected by your antivirus and spyware... but you are not. After research I found that internet security only protects you if the program hasnt allready been given permission to enter. And seeing that Magic Jack was given that permission,.....Guess what you gave them permission. So are you protected?....NO. They can see what you are doing even if the Magic Jack is unplugged, seeing that it is a hidden embedded file, that continuously, runs. Anytime time you get on the computer, and the ethernet cable is plugged in to your computer, they can transmiit information. You gave them the key to your backdoor.

HI my name i Alex,and i had my magicjack for about 3-4 mons and a first it worked very good,then i started to have all kinds of problems.I troubleshooted
it many times. And when i contacted them for a REPLACEMENT they would not send it, or lessen to me.
I told them that i will let every body know about that,they replayed (do what you need to do) so i just wonted to let everybody to know that this is what you can expect from this kind of service. You will pay for year and be able to use it for couple of mounts.

i am seriously considering getting a majic jack. but now that i read these blogs, i am more cautious! perhaps this is REAL, ya know? if you can prove weatherbug did this, why cant majik jack? gotta warn all of the others that shown interest in this. perhaps the blank account would also be a decent protection, but then again, if it gets past SPYWARE, why cant it get past all accounts and be in the main system?? seems possible to me, unless someone can better explain the TRUE SEPARATION of these user accounts to me...

I have MJ and love it. The only problem I have once in a while is the software gets corrupt and I have to format the MJ drive.
You have to leave the computer on all the time to get or place calls is the only drawback I see. You will pay more in electricity than a regular phone .

I just got a majicJack and began using it today. The quality is the same as the phone company and it was really easy to install. I read the TOS and had some concerns as well. There is a comment by someone on this blog that says to create a different identity on your internet browser and use that. That will work great. If you are using broadband and have more than one computer or an older computer that you can connect then you can just use that computer for the phone and other non personal business and get around any potential problems as well. Bottom line for me is about $1.70 per month for phone service is a whole lot cheaper than the phone company and majicJack can't do anything any worse than the phone company already does to you.

If I lived in the US I don't think I would use a Majic Jack. But as an ex-pat, in Bolivia, it is really great for calling the US. I just switch phone cords into the phone and get a US dial tone.

I am now leaving this blog much more confused than when I entered it, absolutley no closer to a decision.
Most of the comments posted on this blog look and sound as if they were written by children...I'm sorry but i can't put much confidence in a comment someone writes when they misspell every other word..."leik?"...over and over even.

I was considering a MJ as well and glad I came across this site. As an Information Security/Risk Mgmt Consultant for banks, I am pleased to see others who do their homework before attaching a device such as this to their PC. With the rapid increase in identity theft, this appears to possibly be laying a foundation to add fuel to this fire. I'm a little confused however, in that MJ would not be subjected to future legal action because they should be held to the requirements of the FTC's Safeguard/Privacy Rules (GLBA). This law requires that they disclose the type of non-public personal information they collect and whether or not they share or sell it to 3rd parties. If they do, they are required to give consumers the ability to opt out of this "sharing". One of the exceptions to this, is where the "sharing" is necessary to provide the service. This is probably why they are saying that this is the reason for collection of data. But honestly, I can't see the reasoning behind that argument. If you feel that you have been scammed or your privacy has been vilated, it might be worth filing a complaint with the FTC. Whether you signed the TOS or not, if they did not give you the ability to opt out, they likely violated the law. It also makes me wonder if Wal-Mart is on the receiving end of some of the "data" they collect. Not saying they are; it just makes me wonder.

I bought a Magic Jack to experience the savings and the new technology. I have a bit of a older computer with USB-1 ports. I connected my Magic Jack following all the instructions very carefully, then tried the phone finding myself disappointed. It made calls, but the software would keep disconnecting and recycling itself back up every few minutes. Also the voices I heard on the phone sounded like they were under water sometimes (kinda worbly).
Refusing to say no to this invention, … I took my Magic Jack and a smaller house phone to our local public library and hooked up on one of the public computers. I’ll be damned, the performance left me absolutely speechless. Rock solid stability, crystal clear audio and it wasn’t dropping my calls.
This told me my purchase of the Magic Jack was a good one. The problem I was having at home must have been in my computer.
My next stop was a computer shop where I walked them through my experiences carefully and then asked for their advice. The guy in the computer store asked if I had usb-2 ports on my computer, … I replied “No just usb-1 ports”. He confidently put a small box on the counter top that was labeled usb-2 pci card. He said “From what you just told me, I’m positive this will solve your problem because phones are like a type of media, the usb-2 ports run more than twice as fast as the usb-1 ports. Your usb-1 ports are working, but they are struggling to get the job done. Usb-2 ports won’t struggle to work your Magic Jack”.
I went home and installed my new usb-2 port which cost less than $25.00, … then retried my Magic Jack and telephone. I was floored! It was behaving just as it did in the library. Rock solid stability, crystal clear audio and I never saw it drop another call or senselessly recycle itself ever again.
I am very happy. I’ve been using my Magic Jack for years with no complaints, and pocketing the savings on my telephone activity.
I’m very thankful to whoever invented this device. I also like the lower prices they came out with, … renew at $59.00 for five years. Absolutely sensational!

Again, I"m astounded that a public library would not have better security on it's workstations and prohibit users from attaching external devices and installing third-party software at will. I'm not necessarily questioning the validity of your story and saying they don't, but if they do, it is this type of complacency and/or ignorance that places them and other users at risk. IMO, the best thing to do with respect to the MJ, is to read the TOS and understand exactly what you will be signing up for if you do go forward with the service. But, also understand that you do have the right to request the ability to opt out of sharing. Ask them to provide you with a written copy of their Privacy Policy and if you do not want them to share your personal information with 3rd parties, tell them that you want to sign an opt out. In addition, you should also ask them if they have implemented a "Red Flag" program, which allows them to detect, prevent, and mitigate identity theft. This is a program they are required to have in writing and implemented no later than May 1st. If they are a company of integrity and are compliant with the law, they should be willing to attest to the fact that they have such a program in place. Get this attestation in writing. Then if your information is compromised at any time, you would have a strong legal basis for restitution. If they are not compliant or refuse to provide you with the attestation, I can guarantee you, this is not something the FTC would take lightly.

I too was taken in by the Magic Jack but only after checking with a few other people. My cousin in Florida says he has owned one for years and is totally satisfied with it. My brother-in-law has had his for over two years and raves about it. With that, I decided to order one on-line. The gadget worked perfectly for about two weeks, then boom! I began to have several problems. When my computer wasn't locking up, it was running extremely slow. Then I got a terrible virus and had to take the computer to have the virus removed. The computer has not worked properly since.
This may be a hit or miss device as it seems to work for some but not for others. Unfortunately, they have gotten $40.00 out of me, which pisses me off. I think about the millons of dollars the company has received from people like me who end up with a product that is no good. What a scam!!!!
Oh, I forgot that there was a class action lawsuit against the company in Florida.
